In the Matter of Adoption of Revisions to Certain Local Bankruptcy Rules and Forms (Chapter 13 Plan Form) Effective February 1, 2013. This General Procedure Order makes primarily cosmetic formatting changes to allow the form plan to be mailed on fewer pages. There are some areas with substantial language changes which are in the highlighted version (click here to view the PDF); the new form plan is available in Word (view plan form in MS Word). In the Matter of Adoption of Revisions to Certain Local Bankruptcy Rules and Forms (Chapter 11). Pursuant to 28 U.S.C. § 2071, Rule 83 of the Federal Rules of Civil Procedure and Rule 9029 of the Federal Rules of Bankruptcy Procedure this General Procedure Order is adopted to make revisions to certain Local Bankruptcy Rules (L.B.R.) and Local Bankruptcy Forms (L.B.Forms), and add to the L.B.R., pending their formal adoption. This GPO will be effective February 1, 2013, it covers minor revisions to the Local Bankruptcy Rules dealing with Chapter 11 cases and creates a new rule and form when receivers are involved. In the Matter of the Continued use of Official Stamps Bearing the Name Bradford L. Bolton, Clerk Commencing January 4, 2013, Kelly J. Sweeney shall serve as Acting Clerk, pending the official appointment of the new Bankruptcy Clerk of Court. The Court shall use official stamps bearing the name Bradford L. Bolton, Clerk, with the same force and effect as if the stamp said Kelly J. Sweeney, Acting Clerk.

In the Matter of Electronic Processing of Installment Fee Payments in Attorney Filed Cases. Consistent with the mandatory electronic filing requirements of L.B.R. 5005-4, this General Procedure Order clarifies that mandatory electronic filers also are required to process fee payments through the electronic filing system. Please remember that the Court will only accept the efiling attorney or the law firm's credit card to process the payments. Effective December 17, 2012, this applies to all installment payments due or to be made in any cases filed by efiling attorneys, please contact the ECF Training Team with questions. In the Matter of Adopting Interim Rule 1007-1. This administrative General Procedure Order adopts the changes to the Interim Fed.R.Bankr.P. 1007-1 that was amended to conform to the new time periods and to correct an inconsistency created by the 2010 amendment to that rule.

Revision of Local Bankruptcy Rule 9070-1(a)(3) to reconcile its application with appellate court rules or procedures. This modification requires that exhibits be retained and provided to any appellate court according to that court's rules or procedures. Reassignment of Additional 3018 Cases to Standing Chapter 13 Trustee Douglas Kiel. General Procedure Order 2012-1 (GPO) contains the list of all cases reassigned from Standing Chapter 13 Trustee Sally Zeman to Douglas Kiel effective February 1, 2012 and the administrative procedure to effectuate the change.

Addition of Standing Chapter 13 Trustee Douglas Kiel and reassignment of approximately 2000 confirmed Chapter 13 cases. General Procedure Order 2011-1 (GPO) contains the list of all cases reassigned from Standing Chapter 13 Trustee Sally Zeman to Douglas Kiel effective October 1, 2011 and the administrative procedure to effectuate the change.

In the Matter of Court Operations During Appropriations Lapse. The attached administrative order establishes that the U.S. Bankruptcy Court will continue to operate if there is a lapse in appropriations.

In the Matter of Exception to Paper Service Upon the United States Trustee of Motions for Relief from the Automatic Stay and Responses Thereto. As a result of this GPO, service upon the United States Trustee of the motion for relief from stay or any response thereto is completed by the electronic filing of the motion or response in the Court's Electronic Case Filing System. In the Matter of Adoption of Revisions to Certain Local Bankruptcy Rules and Forms. Minor corrections and clarifications have been made to certain Local Bankruptcy Rules and Forms, effective July 1, 2010. The GPO contains a list of the rules and forms modified.

In the Matter of Mandatory Electronic Filing for Certain Creditors and Their Agents Filing Proofs of Claim or Interest. This General Procedure Order requires creditors and their agents who file with the Clerk, on average, one or more proofs of claim per week to file them electronically. (Vacated by GPO 2014-1 as it is incorporated into L.B.R. effective 1/1/2014)

In the Matter of Chapter 13 Fee General Procedure Order. Pursuant to L.B.R. 2016-3, this General Procedure Order establishes the presumptively reasonable fee allowance of $3300 for cases filed on and after December 1, 2009.

In the Matter of Obsolete General Procedure Orders and Standing Orders of the Court. This General Procedure Order vacates those General Procedure Orders and Standing Orders that are now obsolete, superseded, inconsistent with current rules or otherwise no longer serve any useful purpose or benefit to the administration of bankruptcy cases. It also reassigns a naming and numbering system for those General Procedure Orders and Standing Orders that are being retained. All of the orders designated as "GPOs" under the new system are attached to GPO 2009-3.

Although this GPO, 2007-2, is retained as part of GPO 2009-3, it is included on this page for ease of reference and format.
